Failure to provide Electrical Certificate for a HMO results in prosecution

The Private Sector Housing at South Holland District Council prosecuted Mrs Pite, the manager of Mercia Lodge in Spalding and the Annexe, for failing to provide an Electrical Condition Report under Regulation 6 of the Management of Houses in Multiple Occupation (England) Regulations 2006.

 

Legislation requires that every fixed electrical installation is inspected and tested at intervals not exceeding 5 years by a person qualified to undertake such inspection and testing. That manager should obtain a Certificate from the person conducting that test specifying the results of the test and must supply that Certificate to the Local Housing Authority within 7 days of receiving a request for it in writing from the Authority.

 

Mrs Pite attended Boston Court where she admitted there is not an Electrical Condition Report for either property. The Court accepted her guilty plea and she was fined £1,760. The Court ordered her to pay £2,000 towards the costs of bringing a Prosecution and a victim surcharge payable to the Court of £170.
