Right to Rent Scheme Update Changes
The Home Office advised us on 22 June 2021 of the legislative change to the Right to Rent Scheme, which since came into force on 1 July.
This changes the way in which EEA citizens prove their right to rent in England.
To support this change, they made some minor amendments to the code of practice and republished the guidance for landlords on 6 July.
The changes:
- Confirm when a tenancy is considered as being entered into for the purpose of a right to rent check; and
- update acceptable document List A, Group 1, to confirm documents 7 and 8 can be either current or expired.
They have also updated the ‘Landlord’s guide to right to rent checks’ to provide guidance on:
- Changes to student tenancy agreements;
- Right to rent checks for individuals granted status under EU Settlement Schemes of the Crown Dependencies (Bailiwick of Jersey, Bailiwick of Guernsey and Isle of Man) or who have an outstanding application made by 30 June to the Bailiwick of Jersey or Bailiwick of Guernsey EUSS; and
- Right to rent checks for individuals who have an outstanding application to the UK EU Settlement Scheme, made by 30 June.
